Formal conditions (C1) – German grammar

Contracts use formal words for conditions: Eine Untervermietung ist zulässig, sofern der Vermieter zustimmt.

The main points

sofern = provided that; formal wenn or falls. Verb at the end.
vorausgesetzt, dass: a must-have condition. Comma before dass, verb at the end.
im Fall(e), dass = in the event that. Verb at the end.
es sei denn = unless. Then normal main clause order: verb second.
vorausgesetzt without dass: verb in position 2. Never es sei denn wenn.

When you use it

sofern: provided that
- Eine Untervermietung ist zulässig, sofern der Vermieter vorab schriftlich zustimmt.Subletting is permitted, provided that the landlord gives prior written consent.
- Sofern nichts Abweichendes vereinbart wurde, gilt die gesetzliche Kündigungsfrist.Unless something else was agreed, the legal notice period applies.
In contracts, AGB and official letters, sofern replaces wenn or falls. It sets a binding condition. The verb goes to the end.
Tip: In everyday speech, people almost always say wenn or falls.

vorausgesetzt, dass: a must-have condition
- Eine Verlängerung des Arbeitsvertrags ist möglich, vorausgesetzt, dass die Projektfinanzierung bewilligt wird.An extension of the employment contract is possible, provided that project funding is approved.
- Der Mieter darf bauliche Änderungen vornehmen, vorausgesetzt, er trägt sämtliche Kosten selbst.The tenant may make structural modifications, provided he bears all costs himself.
vorausgesetzt (, dass) names a condition that must be met first. Only then does the main clause apply.

im Fall(e), dass: in the event that
- Im Fall, dass beim Auszug gravierende Mängel festgestellt werden, wird die Kaution einbehalten.If serious defects are found when the tenant moves out, the deposit will be kept.
- Im Fall, dass eine Vertragspartei in Verzug gerät, fallen gesetzliche Verzugszinsen an.If one party pays late, legal default interest is due.
Contracts use im Fall, dass or im Falle, dass for events that might happen, like damage or late payment.

Some connectors send the verb to the end. Others keep main clause order, with the verb in position 2.

Choose the right word
A formal condition: sofern. A must-have condition: vorausgesetzt, dass. A possible event: im Fall, dass. The one exception: es sei denn.

es sei denn keeps main clause order. vorausgesetzt, dass sends the verb to the end.

Before or after the main clause?
sofern, vorausgesetzt, dass and im Fall(e), dass can come first or second. es sei denn almost always comes after the main clause.
- Nachfristsetzung ist entbehrlich, sofern der Schuldner die Leistung verweigert.An extra deadline is not needed if the debtor refuses to pay or perform.
- Sofern der Schuldner die Leistung verweigert, ist eine Nachfristsetzung entbehrlich.If the debtor refuses to pay or perform, an extra deadline is not needed. (The verb comes straight after the comma.)

Without dass, es sei denn keeps the verb in position 2: zeigt … an.

es sei denn adds an exception to a rule. Put the main clause first.

Put a comma before dass. That is the common and safe spelling.

Exceptions

Tap one to open it.

Learners often send the verb to the end, as after weil. Without dass, the verb stays in position 2.
- ✗ ... es sei denn, der Mieter die Frist einhält.Wrong.
- ✓ ... es sei denn, der Mieter hält die Frist ein.... unless the tenant meets the deadline. (right)
- ✓ ... es sei denn, dass der Mieter die Frist einhält.... unless the tenant meets the deadline. (right, with dass)
Without dass, the next clause has main clause order. Both are correct; the version with dass is a little more formal.
- ✓ Die Prämie wird ausgezahlt, vorausgesetzt, das Umsatzziel wird erreicht.The bonus is paid out, provided the sales target is reached.
- ✓ Die Prämie wird ausgezahlt, vorausgesetzt, dass das Umsatzziel erreicht wird.The bonus is paid out, provided that the sales target is reached.
sofern can also mean 'to the extent that', like soweit.
- Der Vertrag bleibt wirksam, sofern er nicht gegen geltendes Recht verstößt.The contract remains effective in so far as it does not violate applicable law.
- Sofern zutreffend, bitte ankreuzen.Where applicable, please tick. (fixed phrase on forms)
Legal texts often turn the clause into a noun phrase: im Falle + Genitiv (see M07).
- Im Falle, dass der Mieter verspätet zahlt, ...In the event that the tenant pays late, ... (clause)
- Im Falle verspäteter Zahlung des Mieters ...In the event of late payment by the tenant ... (noun phrase)

sofern, solange, es sei denn or sonst?

Four words you often find in contracts. They differ in meaning and word order.

§ 7 Zahlungsbedingungen und Leistungsunterbrechung
(1) Die Vergütung für gebuchte Cloud-Dienste ist monatlich im Voraus fällig.
